Probate costs are almost always paid out of the estate, not from the executor's own money. There are two main elements: solicitor's professional fees and Probate Office (court) fees and outlay.
Solicitor's fees — the three common models
- Percentage of the estate. Traditionally around 1%–2% of the estate value plus VAT. On larger estates this can be negotiated down.
- Fixed fee. Increasingly common for straightforward estates — you know the price up front.
- Hourly rate. You pay for the time actually spent; good for simple estates, less predictable for complex ones.
Always ask for a Section 150 letter. Irish solicitors are required to give you written notice of fees before taking on the work. Get the basis of the fee — and an estimate — in writing, and compare quotes.
Probate Office and other charges
On top of the solicitor's fee you may have court probate fees, swearing fees, property registration (Tailte Éireann) charges, valuation fees, and the cost of advertising for creditors where appropriate. These are usually modest relative to the estate.
